Why Sunday June 1 is a key day

Pay particular attention to this sentence:

“It also comes with a non-refundable $5,000 wire-transfer payment.”

There is not a ACH wire transfer option on weekends after the banks end the process long before the day is over M-F unless already queued in the system so the recipient knows it’s in the system and the MWC decides a June 2 payment receipt is acceptable. A western union money gram could count but if it involves a bank account it will be slower than an ACH. This has to have been resolved earlier today (5-30) or it would mean the MWC has agreed to negotiate the exit process.

The MWC resignation process:

1.04 Resignation.

(a) Any Member Institution may resign from membership in the Conference (such resigning Member Institution, the “Resigning Member”) June 30th of each year (the “Effective Date”) by delivering (i) written notice (the “Exit Notice”) to the Conference and the other MemberInstitutions on or before June 1st of the preceding year (the “Resignation Deadline”) and (ii) a non-refundable $5,000 payment by wire transfer of immediately available funds to an account specified by the Conference (the “Exit Deposit” and, together with the Exit Notice, the “Notice of Resignation”) that will be applied to the Exit Fee (as defined below). Both the Exit Notice and the Exit Deposit must be received for the Notice of Resignation to become effective. The period
from the date the Resigning Member delivers the Notice of Resignation (such date, the “Resignation Date”) through the Effective Date is referred to herein as the “Interim Period.” The resignation of a Member Institution does not relieve the such Resigning Member Institution from any obligations such Resigning Member Institution may have to the Conference as a result of obligations incurred or commitments made prior to the Effective Date. (Revised June 2011, April 2021, December 2023)


Effective April 30, 2021 and thereafter any notice of resignation given by any Member shall be subject to the Notice Date referenced in subparagraph (a) above and the following: the resigning Member shall pay to the Conference as an Exit Fee an amount equal to three times the average per Member Conference distribution payment for the preceding year. (the “Timely Notice Exit Fee”) If the resigning member gives notice after the established “Notice Date”, the resigning Member shall pay to the Conference as an Exit Fee an amount equal to double the Timely Notice Exit Fee. After receiving Notice of Resignation from a Member, all payments due that Member from the Conference shall be withheld and applied to that Member’s Exit Fee.

The balance of the Member’s Exit Fee as provided above, shall be paid by the Member to the Conference on or before the Effective Date. (Revised June 2011, January 2013, July 2016, April 2021)

A resigning Member shall play all athletic competitions included in the Conference schedules until the Effective Date of the resignation.

(d) On the Notice Date a director appointed by a resigning Member shall be deemed to have resigned as a director effective on the Notice Date.

(e) During the Interim Period, (i) the Board of Directors shall be deemed to be reduced by the number of resigning Members and shall be fully empowered to act, as then constituted, to manage the business and affairs of the Conference; and a resigning Member shall be neither obligated nor entitled to appoint a representative to the Board of Directors.

I'm going with the assumption that mediation = stay of all agreements. Thus, the June 1st deadline is largely irrelevant. Jmo.

Pac obviously doesn't have the TV juice so they're crowing about exposure they pay for

My interpretation is that the answere is no. Mediation bought time for the bad guyd.

And one other thing...they DON'T have an 8th full member yet and they need one ASAP. The NCAA waiver allowing the conference to have less than 8 full members aint going to last forever for the PAC Whatever you know.

I can’t really say, but it has to be a leverage factor for the MWC.
 
What's the likelihood the traitors just pretend like nothing happened? Do they have any legal obligations to pee12?
There is no information readily available that says the traitors are financially or even legally locked into the pee12.

The pee12 has a lot to accomplish in a short time period to stay solvent and must retain all traitors and pick up at least one more team and the June 1 issue may impact other conferences exit fees as well.

The way I see it legally with the agreements is that the MWC should have the strongest hand in the negotiations. But as we all know the courts can create upheaval and the MWC might be susceptible to giving in as a survival mode to pay the $61 million to support the GOR.

I’m still hoping for the $100 million number to ease the pain going into college football obscurity since it might not matter in a few years.

They must have the 8th member in place by July 2026. The best cheapest available is the Sun Belt then the CUSA. They already tempted Texas State who said no way unless given a full share.

I do wonder how bad the traitors want to concede total control to the pee2 component.

How I envision the negotiations happening.

MWC: You want us to bend over how far?
P-2: We agree to use lubricant or can go raw dog. Your choice.
MWC: Hmmm…can we think about this?
P-2: Hurry up. We still got a lot of shit to do.
Mediator: Can I watch?
 
Don’t know how the payments will take place but 5 x $18 million = $90 million.

Now - is it at 100% or did it get diluted? The SDSU story appears that the exit fees will stick. If the MWC nets at least 18% of the poaching fees and the exit fee is paid 100% the $100 million level is obtainable.
 
I thought anything could come out this mediation. Even some sort of merger. But now I would be surprised if they don't already know the 8th member given that they gave official notice that they are leaving.
 
My opinion is that MWC got steamrolled. Who knows what the payment will be. But I am less concerned about money than being in a good conference. We lost some good schools and replaced them with UTEP and NIU. Again, no offense at all to those schools. But I feel like the proverbial bottom dweller. The worst part? Pac-2 thought CSU was good enough but Wyoming wasn't. This will stick with me. How in the world does MWC rebuild with this mess. And that fake excitement from Nevarez just pisses me off.

Worse yet, they took Utah State. 20 years ago Utah State was irrelevant. For most of the 1980's USU was in the PCAA, then went to the Big West in the 1990's, then had 2 years as an independent where they were completely irrelevant. Then the Sun Belt which was more near irrelevancy. That was in 2004. There is just no way you could have thought that back in 2004 Utah State would have had this type of success / transition.

And I think the MWC is about to get steamrolled as well. It's going to be tough to see the MWC surviving. I just don't see UC Davis vs. New Mexico basketball having any significance. Wyoming will have nice new stands and beautiful luxury boxes for their big games against Northern Illinois and Hawaii that will have all the high paid administrators in attendance but not many other people.
