P12 - MWC

Kind of what I was thinking. We are in for a long battle. Sick of it already. Imagine being pathetic CSU, USU, Texas State with this crap hanging over your head for years. Pox 12 loses...but by how much?
 
Just wondering if dragging this out will hurt the MWC more than it does the PAC? Seems like the longer this goes the more it favors the PAC. They will have stronger footing in the next couple of years. Only thing we can hope for is the courts rule in favor of the MWC and they win all of the appeals that are sure to follow.
 
The pee12 is absolutely focused on not paying the MWC and destroying it as a competitor. Not surprising at all because the same mindset continues that destroyed the pee12 in the first place. They believe their excrement doesn’t stink and everyone else is beneath them.

This indicates that the MWC held firm to not giving the pee12 a cheap deal or the pee12 was egregiously unwilling to compromise.

September 9 is the hearing on the petition by the MWC to dismiss the suit. The prior dismissal request was vacated when the MWC filed a joint motion to go to mediation. I don’t know if the dismissal is with or without prejudice. With prejudice means pay what is owed and drop all litigation permanently.

Need to find out what goes with the Colorado lawsuit by the traitors because this should mean the poaching lawsuit is going forward in the California Northern District court.

Hopefully Chris Murray from Nevada or a trusted podcaster can provide clarity because we are very unlikely to get diddly squat from a Wyoming media source. This is no secret now so media do your job and ask the questions to inform the public what is at stake. I don’t want to only hear the pee12 version.

I don't think it helps either side - just casts a dark cloud over everything.

We may hear more on the MWC position from Gloria Wednesday at the football media days.

The motion to dismiss is set for a hearing September 9 and if not successful then the suit continues with hearings in October.

What we do know is:

The pee12 won’t be paying the entire penalties unless court ordered.

The MWC didn’t go lowball just to cover the needed $61 million.

The dark cloud is the pee12 is willing to spend a lot more in legal fees and force the MWC to do the same in lieu of paying the MWC. Is this tactic a potential way to destroy the GOR funding and be able to pursue UNLV?

A lot to ask and find out on the possible outcomes.

The losers want to be the only conference for west coast night games. This was planned. Strategic. And shows how low the ewes, the maggie’s, the whole lot is. I’m glad Gloria held firm. I imagine the losers thought they could hardball her and get her to cave.

I still don’t know how the contract cant be enforced. I’m not a legal guy, but a contract is a contract.

The pee12 could lose this because they did knowingly and willingly sign the contracts under the guidance of their lawyers. There is still hope the courts side with the MWC. I am no legal expert either, but I don’t see any way the pee12 walks away without paying something.

Yeah, the poison pill argument is weak at best. There are several other conferences they could have struck a deal with if they didn't like what the MWC offered. That and they just argued why the pac12 defectors should pay up which applies to their contract with the MWC and the MWC defectors.

Further weakening the MWC defectors' case is their pac buyout contract. Can you imagine the cross examination?

1 more thought is that if our TV contract is 3 mill less per team because of departures, then that's 27 mill per year x 6 years (typical tv contract length) = 162 million in damages to the conference. The exit penalties + poaching fees are less than realized damages. The MWC is already being generous by honoring the contract amounts and not asking for more.

The statement from the MWC:

“The Mountain West and Pac-12 mutually agreed to mediation, and as noted in today’s Joint Status Report, were unable to reach a resolution. The case will now proceed to a court hearing on the pending motion to dismiss. The Mountain West provided the Pac-12 institutions with a lifeline, offering a full football schedule for the 2024 season. The Pac-12 willingly signed the scheduling agreement with full knowledge of the contractual provisions and is attempting to avoid its legal obligations. The Mountain West will aggressively protect the interests of our member institutions and is fully prepared to hold the Pac-12 accountable.”

I have to conclude the first action as has been the MWC position is pay the penalties with the request to dismiss. I would be fairly certain the dismissal would be with prejudice which means in finality.

The pee12 is desperate to not pay the $55 million. They know the traitors have a loser case on the exit fees.

It’s all still negotiable and could go to a settlement. Who gets nervous first is to be determined. The MWC only has the legal fees to lose in this. The pee12 could hemorrhage so much from this they won’t make any $$ down the road.

It would be so nice if someone said "And now we turn our attention to the MWC fanbase because, without them, we would not have member institutions, student-athletes, media packages or NIL cash." Probably in the minority here, but athletics largely exists for the fanbase and spectator experience. I get the impression that the fans are becoming less and less important on every level.
 
This situation will set a major tone for all of college football. I guarantee that the ACC, especially Florida State and Clemson will be paying close attention. It might settle, but it better not be by much from the whole summer. Those teams signed the contracts and in good faith supported executing them, they need to be held to that. The pac will not win in court and they know it, but if they’re willing to roll the dice, a judge better realize that their judgment will set a precedent for any conferences grant of rights and agreements for poaching fees. I know that both leagues in the grand scheme of things are peons compared to the P4, but getting out of paying what they need to pay would start some big shifts from ACC, BIG12, and the big 2. And when those apple carts get upset, look out! The Monty Show did a nice job breaking it all down. I’m sure a few of the defectors are at least a little nervous at this point. And good! They should be!

The Monty Show also provided information that CBS will be part of the MWC TV deal.

I liked their comment: “One conference wanted to do damage and one wanted to do business”.

I also agree with them that the pee12 could settle before September 9 because if the lawsuit is dismissed it’s the full $150+ million.
