Martinez Update

I think the argument is that the victim had attacked Luke and punched him, and that Luke was just retaliating. Certainly Luke isn't "innocent"; he kicked the guy. But the circumstances surrounding the incident as a whole could certainly mitigate the seriousness of the offense. No jury is going to convict Luke of aggravated assault if the victim had just punched Luke. My guess is that Luke will plead guilty to a simple misdemeanor assault and do probation and some community service.
 
i just wish for one night we could have him, call me crazy(and you will) but one game only, not allowed to go to the MWC tourney, just to see him one last time, but i understand why he can't. hey dumb actions call for bad things to happen on occassion.

Well, it appears that the defense position is that the guy deliberately struck Luke in the foot with his head.
